1. General Terms
Service Agreement: The client agrees to provide Showmania Events & Entertainment with clear and detailed requirements prior to the commencement of any planning activities. The initial timeline and project specifications provided by the client will form the basis of our quote and service delivery. Only minor changes to these specifications will be accepted without additional charges once the event planning has commenced.
Media and Publicity: Photographs and video footage of the event will be used by Showmania Events & Entertainment. The client may also use these media for other purposes, provided that such use prominently features acknowledgment and credit to Showmania Events & Entertainment.
2. Payment Terms
Deposit and Payment Schedule: The client is required to make a non-refundable deposit amounting to 25% of the total agreed fee at the time of booking to secure the event date. An additional 50% of the remaining fee is due 45 days before the event. The final installment must be paid upon check-in on the day of the event.
Additional Services: Any services requested by the client that are beyond the scope of the initial agreement will incur additional fees. These fees will be discussed and agreed upon before the commencement of the additional services.
Accepted Payment Methods: Payments are accepted via direct deposit, check, online bank transfer, or cash. All payments should be made to “Show Mania Events & Entertainment”.
3. Duties & Obligations
Compliance with Policies: The client must strictly adhere to all policies, procedures, and guidelines set forth by Showmania Events & Entertainment.
Event Promotion: The client agrees to only use marketing and promotional materials approved by Showmania Events & Entertainment and to adhere to the specified methods and extent of promotion.
Advance Reminders: Showmania Events & Entertainment will provide payment reminders to the client 15 days prior to the due date to ensure timely financial management.
4. Limitation of Liability
Force Majeure: In the event of force majeure, including but not limited to acts of God, government actions, war, strikes, and natural disasters, Showmania Events & Entertainment is not liable for any failure to perform its obligations under this agreement. The contract may be suspended or terminated without liability for damages or consequential loss resulting from such events.
5. Permissions & Clearances
Handling of Permissions: The responsibility for obtaining necessary permissions and clearances for the event may be undertaken by Showmania Events & Entertainment on behalf of the client or directly by the client. All associated costs will be accounted for outside of the agreed event fee.
Liability for Permissions Obtained by Client: Should discrepancies or issues arise from permissions or clearances handled by the client, Showmania Events & Entertainment will not be held responsible for any resulting complications during the event.
6. Service Availability
Client Requirements: The ability to meet specific requirements requested by the client is subject to availability and may require advance notice.
7. Confidentiality
Protection of Creative Works: All designs, artistic works, and creative outputs developed by Showmania Events & Entertainment in connection with the event are proprietary and confidential. Unauthorized use, reproduction, or distribution is strictly prohibited.
Mutual Confidentiality: Both parties agree to maintain the confidentiality of information shared during the course of event planning and execution.
8. Jurisdiction
Dispute Resolution: Any disputes under these terms will be governed by the laws of Jaipur, and the parties submit to the jurisdiction of the courts located in Jaipur for the resolution of all disputes.
9. Termination
Cancellation Policy: In case of cancellation by the client, a refund of 50% of the total payments received by Showmania Events & Entertainment will be made, subject to the terms of the cancellation policy discussed at the time of booking.
Breach of Contract: A breach of any of the terms by the client may lead to immediate termination of the agreement, at the discretion of Showmania Events & Entertainment.
10. Independent Contractor
No Agency Relationship: The client shall act as an independent contractor and shall not enter into any agreements or represent itself as an agent of Showmania Events & Entertainment.
11. Taxation
Applicable Taxes: All service fees charged by Showmania Events & Entertainment are subject to an 18% GST, which will be itemized separately in all billing statements.
12. Scope of Service
Service Delivery Commitment: Showmania Events & Entertainment agrees to deliver all services as specified in the contract and to support the client both before and after the sale as part of its customer service commitment.
13. Pre-Contractual Confidentiality
Restriction on Sharing Materials: No materials, images, slideshows, or presentations created by Showmania Events & Entertainment will be shared with the client or any third party over email, WhatsApp, or any other communication channels before the formal signing of the contract. This measure ensures the protection of proprietary content and intellectual property prior to the commencement of a formal agreement. Any unauthorized distribution or use of such materials is strictly prohibited and may result in legal action.
